The Energy Policy Act of 2005 (EPA 05) increased criminal and civil penalties assessable by FERC. The Commission can levy fines up to $1,000,000 for each day of violation. Also, EPA 05 expanded FERC's authority to impose criminal penalties for violating the FPA. This is the new reality.
