On August 22, 2012, the U.S. Securities and Exchange Commission (SEC) issued a 357-page set of rules of compliance for the Dodd-Frank Section 1502. The main objective behind this mandate was to ensure that SEC-reporting organizations utilizing “conflict minerals” or “3TG” sourced from the Democratic Republic of the Congo (DRC) or adjoining central African countries are not financing atrocities in these regions. Under the Dodd-Frank Section 1502, organizations need to file reports with the SEC disclosing the origin of the conflict minerals - whether from the DRC or, recycled or scrap sources, and furnishing details of processes performed to reach these conclusions. The mandate also requires them to trace the source and chain of custody, suppliers, smelters/refiners, and provide audited reports on due-diligence efforts to the SEC as well as disclose details on public website.

This rule has impacted organizations across multiple industries including retail, electronics, appliances, lighting, automotive, energy, food, medical devices, aerospace, jewelry and other consumer goods. For organizations to be able to provide accurate reports, they first need to establish a conflict minerals program with a well-structured compliance framework, an internal diligence infrastructure to meet the SEC reporting obligations, and a visible supply chain model to ensure responsible sourcing.
