The Final Omnibus Rule of the Health Insurance Portability and Accountability Act (HIPAA) came into effect on March 26, 2013. The new rule has several implications for the listed covered entities including vendors, healthcare providers, third party administrators, and business associates, and it aims to strengthen patient privacy rights, while also offering individuals better access to their health information. Additionally, it bestows the Office of Civil Rights (OCR) with stronger rights to enforce compliance.

The security and privacy provisions in the new rule under HIPAA are also expanded by the Health Information Technology for Economic and Clinical Health (HITECH) Act, according to which, patients must be compulsorily notified of any data breach or mishandling of Protected Health Information (PHI). These changes come with far-reaching ramifications, and require organizations to re-assess their existing compliance program, and make the necessary changes to efficiently manage risks and avoid non-compliance.
